Terms and conditions
By entering this competition (the “Competition”), you (the “Participant”) agree to be bound by these terms and conditions. Any information or instructions published by the Promoter (as defined below) about the Competition form part of these terms and conditions.
The Promoter
The promoter of this Competition is Nomad Foods Europe Limited, trading as Birds Eye (the “Promoter”).
Eligibility
This Competition is open to all UK residents aged 18 or over.
Employees or agents of the Promoter or any of its group companies or their families or households or anyone professionally connected to this Competition are not eligible to enter.
No purchase is necessary to enter.
Prize (maximum 3 winners to be drawn)
1st Prize: 4 exclusive signed shirts (1 Winner)
2nd Prize: 1 signed shirt + 1 signed bucket hat (2 Winners)
Competition Period
• The Competition runs and entries will be permitted from the 16th July to the 23rd July 2024 (“the Competition Period”).[WL2]
Entry
• To enter the Competition, Participants must submit their entry by following @BirdsEyeUK on Instagram, liking the competition post and tagging a friend
• Multiple entries per account is not permitted. Any participant found to use multiple accounts to enter will be disqualified and ineligible.
• Due to the nature of the Competition, there is no postal entry equivalent to this Competition.
• Entries that are incomplete or damaged will be deemed invalid. No responsibility is accepted by the Promoter for lost, delayed or damaged data which occurs during any communication or transmission of data.
• The Promoter reserves the right at its absolute discretion to disqualify entries which it considers do not comply with these terms and conditions or any Participant who it reasonably believes has interfered with the fair running of this Competition or are invalid or fraudulent and the published entry may be removed.
• The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid claims including, without limitation, to require further verification as to the identity, age, and other relevant details of a Participant.
• Entries must be made by the Participant personally and individually and must not be made through agents or third parties. Entries or claims (bulk or otherwise) made from trade, consumer groups, syndicates or third parties will not be accepted. Entries or claims by macros or other automated means (including systems which can be programmed to enter), and entries or claims which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that a Participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the Competition in a way that is not consistent with the spirit of the Competition, that Participants entries or claims will be disqualified and any reward(s) received will be void.
Winner Selection
After the end of the Competition Period, the 3 x Winners will be chosen by random from all compliant entries.[JJ3] [WL4]
No correspondence or discussions will be entered by the Promoter concerning either any decision it makes including with regards to the Competition or any winner selection. All decisions taken or made by the Promoter shall be final and binding.
Privacy and Data Protection
The Promoter will only use the personal details supplied for the administration of the Competition and for no other purpose, unless the Promoter obtains specific consent. A Participant may withdraw consent to such use of personal information by writing to the Promoter at their registered address. Other than as set out in these terms and conditions or for the purposes of operating the Competition, the details and information provided by the Participant when entering the Competition or claiming a prize will not be used for any promotional purpose, nor shall they be passed to any third party.
General
• The Promoter shall not be liable for any interruption to this Competition whether due to force majeure or any other factors beyond the Promoter’s control.
• The Promoter reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary the terms and conditions of this Competition.
• The Promoter will not be responsible or liable for: (a) any failure to receive entries due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or entries; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Competition.
• By entering the Competition, the Participant agrees to release the Promoter from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Competition or with the acceptance, possession, attendance at or use of any prize (except death or personal injury caused by the Promoter’s negligence, for fraud, or otherwise as prohibited by law).
· If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
· In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this Competition, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the Competition or these terms and conditions, at any stage, but will always endeavour to minimise the effect to Participants to avoid undue disappointment. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
· Any persons individual taking advantage of this Competition do so on complete acceptance of these terms and conditions.
· All entries or claims must be made by the customer themselves.
· No cash or other alternative reward will be provided in whole or in part, except that in the event of circumstances outside of its control, the Promoter reserves the right to substitute similar rewards of equal or greater value. The rewards have no monetary value, are non-transferable, cannot be resold, auctioned or exchanged.
• This Competition, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with English law. Participants irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Competition.
