  1. All promotional funding must be passed directly on to the consumer in the United Kingdom at the point of purchase of the product from the retailer.
  2. The promotional mechanic designated by Birds Eye must be used unless the retailer opts to self-fund a stronger mechanic.
  3. Funding only applies to products designated by Birds Eye and is not transferable to alternative products without Birds Eye’s prior agreement in writing.
  4. Unless otherwise agreed in writing by Birds Eye, the customer shall provide a minimum of 7 days’ notice of its volume requirements for any promotion, which is not binding on Birds Eye.
  5. Product availability is not guaranteed, and Birds Eye may, in its sole discretion, limit volumes or cancel a promotion on no less than 48 hours written notice to the customer.
  6. Unless otherwise agreed in writing by Birds Eye, promotional funding will be paid up to 90 days following receipt of a correct invoice and evidence of sales at the correct promotional mechanic on products purchased directly from Birds Eye.
  7. Unless otherwise agreed in writing by Birds Eye, claims for promotional funding over the stated maximum limit (stated by volume or value) will not be paid.
  8. In the event promotional funding is paid as a discount on invoice prices and the customer does not ensure compliance with these promotional conditions, the customer will refund such funding (with any associated costs, expenses and interest) to Birds Eye.
  9. Claims must be received no later than one year from the end date of the promotional period. All aged claims identified by the customer’s audit processes must be submitted with all supporting data to Birds Eye no later than the end of the customer’s financial year in which falls the second anniversary of the delivery date of the Goods to which the claim, query or invoices relates.
